Terms & Conditions

These terms, updated 14 December 2025, set out the agreement of sale between you (the “Purchaser”), and K2020708419 (PTY) Ltd trading as Niewenhuis (the “Seller”).

Introduction

  1. These terms and conditions (“Terms”), updated 22 December 2025, set out the agreement of sale between you (the “Purchaser”) and K2020708419 (PTY) Ltd trading as Niewenhuis (the “Seller”). By accessing or purchasing from the Niewenhuis website (www.niewenhuis.co.za), you agree to be bound by these Terms. These Terms comply with South African law, including the Consumer Protection Act, 2008 (CPA) and the Electronic Communications and Transactions Act, 2002 (ECTA), as well as relevant privacy regulations like the Protection of Personal Information Act (POPIA). If you do not agree with any of these Terms, you should refrain from using our website or services.
  2. Niewenhuis, we, us, our, and the Seller mean K2020708419 (PTY) Ltd (Reg. No. 2020/708419/07) trading as Niewenhuis.
  3. You, your, the Purchaser, or the Customer mean the person or entity buying products or using the website.

Products & Orders

  1. Product Descriptions: We strive to ensure all products are described and priced as accurately as possible on our website. However, minor errors or omissions may occur. In the event of a material error (e.g. a pricing mistake that is obvious and unmistakable), we reserve the right to correct it and will inform you of the correct details. You will have the option to reconfirm or cancel your order if an error affected your purchase.
  2. Availability: All orders are subject to stock availability. If a product you order is not available or if there will be a significant delay, we will notify you as soon as possible and offer an alternative product or a full refund.
  3. Pricing: Prices are listed in South African Rand (ZAR) and include VAT (Value Added Tax) at the applicable rate, unless otherwise stated.
  4. Order Acceptance: Your placement of an order is an offer to purchase. Order acceptance (and the existence of a binding sales contract) occurs when we dispatch the product or otherwise make it available to you. We reserve the right to decline or cancel an order for any reasonable reason, including delivery addresses deemed by us to be in dangerous locations, suspicion of fraud or if we cannot fulfill the order (in which case you will receive a prompt refund).
  5. Custom Orders: For products manufactured or customized to your specifications (“Custom Orders”), it is the Purchaser’s responsibility to ensure that all specifications, dimensions, and measurements provided in the design plans or quotes are correct and meet your requirements. We will manufacture the item according to the agreed-upon specifications, and by approving a design or quote you accept that those measurements are correct. Custom Orders may have longer lead times (please allow up to three weeks for custom fabrication). Note that Custom Orders are made specifically for you and cannot be returned or refunded for change of mind, as they are exempt from the usual 7-day return policy. However, if a custom-made product does not reasonably conform to the specifications you provided, you have the right to reject it upon delivery for a full refund or remake. All Custom Orders still carry our 6-month workmanship warranty for defects (see Warranties section below).

Payment

  1. Payment Methods: We accept various payment methods including Electronic Funds Transfer (EFT), major debit/credit cards, and other options facilitated by trusted third-party payment processors.
  2. Payment Timing: Payment is due at the time of order placement (checkout). Orders will not be processed or dispatched until payment has been received and cleared in our account.
  3. Security of Payments: We use secure, industry-standard payment processing. Niewenhuis does not store your banking or card details on our servers. All payments are processed by third-party providers in accordance with their own privacy policies, and by making a payment you give consent to those terms.
  4. Payment Confirmation: Once payment is received, we will send you an order confirmation via email or other contact details provided.

Collections / Click and Collect

  1. Pickup Location: If you choose to collect your order (Click-and-Collect), products are to be collected from our workshop at 20 Enterprise Park, Kuils River, Cape Town, 7580, during the collection hours specified below.
  2. Collection Hours: Orders can be collected on weekdays (Monday to Friday) between 9:00 AM and 5:00 PM. Collections are not available on weekends or South African public holidays.
  3. Notification of Readiness: You will be notified via email (and/or SMS) as soon as your order is ready for collection. Products can be collected as soon as we send this readiness notification. We generally prepare orders for pickup within approximately 2 business days from purchase, but we do not guarantee a specific turnaround time for availability. (The actual preparation time may vary depending on stock and production schedules.)
  4. Identification at Pickup: When collecting an order, the Purchaser (or their authorized representative) should present the order confirmation and a valid ID. We may require the person collecting to sign for receipt of the goods.
  5. No Collection Fee: There are no additional fees for choosing collection. Selecting Click-and-Collect will not incur any shipping charges on your order.
  6. Uncollected Orders: We request that you collect your order promptly after being notified. If an order remains uncollected for an unreasonable time (e.g. more than 14 days from notification) without prior arrangement, we may contact you with a reminder or arrange delivery at your cost. We reserve the right to charge reasonable storage fees for excessively delayed collections, or to cancel the sale and refund you (minus any costs incurred) if the item is never collected, in line with applicable law.

Shipping & Delivery

  1. Delivery Service & Cost: If you opt for delivery, a delivery fee will apply. Our standard rate is R11 per km from our operating address at 20 Enterprise Park, Kuils River, Cape Town, 7580 calculated via Google Maps (subject to a minimum charge). Flat-rate or promotional delivery fees may apply in certain cases or areas (as advertised).
  2. Delivery Schedule: Deliveries are conducted on weekdays (Monday to Friday) between 10:00 AM and 5:00 PM. We do not deliver on weekends or public holidays. We will attempt to coordinate a delivery time slot with you.
  3. Delivery Timeframe: We aim to deliver in-stock items within a reasonable time (usually within 5-7 business days for local deliveries, or as otherwise indicated for your area). Made-to-order or custom items will be delivered after they have been manufactured, within the timeframe communicated to you. While we strive to meet estimated delivery times, delays can occur due to circumstances beyond our control. We will not be liable for minor delays, but if a significant delay arises, we will inform you and you may have the option to cancel the order for a refund.
  4. Risk & Ownership: Risk of loss or damage to products passes to the Purchaser once the product is delivered to the specified address or when collected by you (or your appointed agent) from us. Ownership of the goods passes to you only once full payment has been received by Niewenhuis.
  5. Delivery Procedure: Our delivery personnel (or appointed courier) will deliver to the address provided at checkout. It is your responsibility to ensure someone is available to receive the goods at that address during the scheduled time. The receiver may be asked to sign a proof of delivery. If no one is available at the time of delivery, we will attempt to reschedule, and additional delivery fees may apply for repeat delivery attempts.
  6. Inspection on Delivery: Please inspect the goods upon delivery. If there is any obvious damage or discrepancy, inform the delivery personnel to return the product and contact us immediately. (For rights regarding defective goods, see the Warranties and Returns sections below.)

Returns & Refunds

  1. 7-Day Return Policy (Cooling-Off): We want you to be satisfied with your purchase. Pre-made products purchased through our online store can be returned within 7 days of receiving them for a full refund of the purchase price, provided the item is in its original condition (undamaged, with no signs of use beyond initial inspection). Note: any original delivery/shipping fees are not refundable in a change-of-mind return.
  2. Return Process: To initiate a return, you must notify us within 7 days of delivery. We will arrange to collect the product from you if it was originally delivered by us, and we will cover the transport costs for returns of delivered products. If you originally opted to collect the product (i.e. you used a click-and-collect shipping option), you will need to return the product to our address (20 Enterprise Park, Kuils River, Cape Town, 7580) at your own cost, as free return collections only apply to items we initially delivered.
  3. Condition of Returned Items: Returned products should be in the same condition as delivered. We reserve the right to inspect the returned item. If the item is not in a re-saleable condition (unless it was returned due to a defect under warranty), a refund may be refused or a reasonable restocking fee may be charged, as permitted by law.
  4. Exclusions: Custom-made products (special orders made to your specifications) are not eligible for return or refund under the 7-day cooling-off period (unless the product fails to meet the specifications or is defective). Additionally, any items that have been altered after delivery, or otherwise used in a way that goes beyond normal handling (as allowed in a store to evaluate the product), may not qualify for a change-of-mind return.
  5. Refund Procedure: Once we receive and inspect the returned item, we will inform you of the approval or rejection of the refund. If approved, refunds are processed within 14 days of approval (typically refunded back to the original payment method unless otherwise arranged). Note: Any original delivery fee charged is not refundable, except where the return is due to a confirmed defect or an error on our part.
  6. Return Documentation: The Purchaser (or their representative) must provide the original invoice, order confirmation, or other valid proof of purchase when requesting a return.
  7. Statutory Rights: These return policy terms do not limit or replace your statutory rights. In particular, if a product is defective or not of acceptable quality, you may have the right to return it up to 6 months from receipt under the CPA’s implied warranty of quality (see the Warranties section below for details). We will handle such cases in compliance with the law, which may entitle you to a repair, replacement, or refund as appropriate.

Warranties

  1. 7-Day Satisfaction Guarantee: We stand by our products. In addition to your legal rights, Niewenhuis offers a 7-day satisfaction guarantee on our standard (non-custom) products. This means if you are unsatisfied with a standard product for any reason, you can return it within 7 days for a refund or exchange (as described in Returns & Refunds above). This guarantee covers issues of fit, finish, or general satisfaction upon initial receipt.
  2. 6-Month Workmanship Warranty: All Niewenhuis products are covered by a 6-month workmanship warranty that begins from the date of delivery/collection. This warranty covers any defects in materials or craftsmanship that may emerge under normal use. If a product develops a manufacturing-related defect within 6 months, we will, at our discretion, repair the item, replace it, or issue a refund. This warranty does not cover damage or defects caused by misuse, abuse, neglect, unauthorized modifications, improper assembly by the Purchaser, or normal wear-and-tear over time.
  3. Warranty Claims: To make a claim under the 6-month warranty or the statutory warranty, please notify us as soon as you discover the defect. We may require evidence of the issue (e.g. photos) or arrange an inspection. If a repair or replacement is warranted, we will arrange this at no cost to you. Any repair work will carry at least a 3-month warranty or the remaining original warranty period (whichever is longer), as required by the CPA.
  4. Custom Orders Warranty: Custom-made products are covered by the same 6-month workmanship warranty for manufacturing defects, but they do not carry any satisfaction or fit guarantee beyond the specifications provided by you. It is crucial that you review and approve all design specifications and dimensions beforehand; the Seller will not be liable for issues arising from the correct fulfillment of custom specifications (for example, if the item’s dimensions were as requested but the item does not fit in the intended space). However, if a custom product has a clear defect in workmanship or materials within 6 months, it is eligible for repair or replacement under this warranty (or refund if repair/replacement is not feasible).
  5. No Other Warranties: Except for the express guarantees outlined above (and your legal rights under the CPA), no other warranties or guarantees (whether express or implied) are provided. We specifically disclaim any implied warranties of quality, durability or fitness for a particular purpose except as provided by law.

Limitations & Liability

  1. Indirect Damages: To the fullest extent allowed by law, Niewenhuis shall not be liable for any indirect, incidental, special, or consequential losses or damages arising from your use of our products or website, or from any breach of these Terms. This includes, without limitation, any loss of profit, loss of business, loss of data, or any downtime.
  2. Liability Cap: Our total liability to you for any claim arising from a product or these Terms (whether in contract, delict/tort, or otherwise) is limited to the amount you paid for the specific product in dispute. For example, in no case will Niewenhuis be liable for an amount exceeding the purchase price of the item that gave rise to the claim.
  3. Events Beyond Control: We are not responsible for failures or delays in performance caused by circumstances beyond our reasonable control. This includes, but is not limited to, events such as acts of God, strikes, fires, floods, wars, pandemics, government restrictions, power or internet outages, or other force majeure events. In such cases, we will do our best to inform you and mitigate the issue, but you acknowledge that some commitments may be delayed or prevented.
  4. Product Use and Installation: The Purchaser is responsible for the proper use and maintenance of the products. We shall not be liable for any damage or injury resulting from improper use, or failure to follow care instructions for our products. Please use products only for their intended purpose and adhere to any provided instructions or warnings.
  5. Third-Party Services: Any third-party services used in connection with your purchase (such as payment gateways or delivery services) are used at your own risk. We are not liable for the acts or omissions of third parties; however, we will assist in resolving issues caused by third-party services to the best of our ability.

Amendments & General

  1. Changes to Terms: Niewenhuis reserves the right to amend or update these Terms & Conditions from time to time (for example, to comply with new laws or to reflect changes in our business or policies). When we make material changes, we will update the “Last Updated” date at the top of this document. It is your responsibility to review the Terms periodically. By continuing to use our website or services after changes are posted, you will be deemed to accept the updated Terms.
  2. Entire Agreement: These Terms, along with any additional policies or terms explicitly referenced (such as our Privacy Policy and any product-specific warranties or terms), constitute the entire agreement between the Purchaser and the Seller regarding your purchase and use of our services. This agreement supersedes any prior or contemporaneous communications or proposals, whether oral or written, relating to the same subject matter. No amendment or waiver of any provision of these Terms will be binding unless in writing and signed by an authorized representative of Niewenhuis.
  3. Severability: If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining Terms, which will continue to be valid and enforceable. In such an event, we will endeavor to replace the invalid provision with a valid one that most closely achieves the intent of the original provision.
  4. No Waiver: Any relaxation, indulgence, or failure by the Seller to enforce any right in these Terms (or any delay in enforcing a right) does not constitute a waiver of that right. We still retain the right to enforce it at a later stage. Similarly, no waiver of any specific breach or default shall constitute a waiver of any other or subsequent breach or default.
  5. Interpretation of Ambiguity: The headings used in these Terms are for convenience only and shall not affect the interpretation of the clauses. Both parties agree that the rule of contract interpretation that ambiguities are interpreted against the drafter shall not apply to these Terms – in other words, these Terms will be interpreted fairly and neutrally, without advantage to the drafting party.
  6. Assignment: The Purchaser may not cede, assign, or transfer any rights or obligations under this agreement to any third party without the prior written consent of the Seller. The Seller may transfer its rights and obligations under these Terms to a third party in the event of a merger, acquisition, or sale of business, provided that such third party agrees to be bound by these Terms.

Governing Law

  1. Governing Law: These Terms and any separate agreements for sale of products or services to you are governed by and construed in accordance with the laws of South Africa.
  2. Jurisdiction: You agree that any dispute or claim arising out of or relating to these Terms (or the breach thereof) shall be subject to the jurisdiction of the courts of South Africa. If you are a consumer as defined in the CPA, you may also pursue dispute resolution through the Consumer Goods and Services Ombud or other dispute resolution body as applicable.
  3. Dispute Resolution: We encourage you to contact us first to attempt to resolve any concerns informally. Should any dispute arise that we cannot resolve through our customer service process, we will consider reasonable requests for mediation or arbitration as alternatives to litigation. This does not override your right to seek relief in court, but alternative dispute resolution (ADR) may be a faster and cost-effective option to settle disagreements.
